Ind. Winery Sues Can Maker Over Foul Cider Smell

Wed, 01/16/2013 - 12:26pm

BLOOMINGTON, Ind. (AP) — A southern Indiana winery is suing a beverage can manufacturer, alleging that aluminum cans it made caused the winery's hard apple cider to develop a foul odor.

Bloomington-based Oliver Winery sued Broomfield, Colo.-based Ball Metal Beverage Container Corp. last month in Monroe Circuit Court. That case was transferred to federal court in Indianapolis last week.

The Indianapolis Business Journal reports that Oliver Winery claims the 8-ounce aluminum cans the company supplied for its cider produced a chemical reaction in contact with the cider that created a foul odor and spurred customer complaints.

The suit says the winery issued a voluntary recall of the cans of cider and has since suffered "significant damage."

A Ball Metal Beverage Container declined to comment on the suit, citing company policy.
